Costa eGift Card Terms and Conditions of Use
These Terms and Conditions apply to use of Costa eGift Cards.
In these Terms and Conditions: "Costa", "we" or "us" refers to Costa Limited a company incorporated in England with company number 01270695 whose registered office is at Whitbread Court, Houghton Hall Business Park, Porz Avenue, Dunstable, Bedfordshire, LU5 5XE . "you" refers to the user of the Costa eGift Card.
Use of a Costa eGift Card will constitute acceptance of these Terms and Conditions. Please read these Terms and Conditions carefully before using your Costa eGift Card. If there is anything you do not understand, please contact us using the contact details in paragraph 13.
We recommend that you keep a copy of these Terms and Conditions for future reference. These Terms and Conditions are only available in English.
2. Using your Costa eGift Card
You may use your Costa Gift Card to purchase eligible items at any participating Costa outlets in the UK excluding Northern Ireland. When you use your Costa eGift Card the amount of your purchase will be deducted from the balance on the card. The remaining balance may be applied to future purchases. Change will not be given. If your purchase exceeds the balance on the Costa eGift Card you must pay the excess by another payment method.
You may check the balance on your Costa eGift Card at any participating Costa outlet. You may not top up the balance on your Costa eGift Card however you may transfer any outstanding balance to a new Costa eGift card at any participating Costa outlet or by contacting Customer Services at email@example.com.
You may not exchange or redeem your Costa eGift Card for cash.
We reserve the right to refuse to accept damaged Costa eGift Cards or any Costa eGift Card which we believe has been stolen or is being used fraudulently.
3. Expiration and Cancellation
Your Costa eGift Card and the balance on it will expire if the card is not used to make a purchase for 12 consecutive months. We reserve the right to cancel your Costa eGift Card if we suspect it is has been stolen, is being used fraudulently or in breach of these Terms and Conditions.
4. Loss, Theft, Damage
You should take care of your Costa eGift Card and treat it like cash. Costa is not responsible for lost or stolen cards. You should immediately report any loss, theft, fraudulent or unauthorised use of your Costa eGift Card to Customer Services at firstname.lastname@example.org. If you lose your Costa eGift Card or it is stolen or damaged we may, at our sole discretion, issue a replacement Costa eGift Card credited with the unused balance from your lost/stolen/damaged card. If you have not registered your Costa eGift Card we will require your Costa eGift Card number and proof of purchase before we can consider any request to replace your Costa eGift Card. If you subsequently find or retrieve a Costa eGift Card which you have reported lost or stolen, you must notify Customer Services immediately.
5. Costa Coffee Club
Purchases made with Costa eGift Cards in participating Costa outlets will be eligible to earn Costa Coffee Club points. Please ensure your Costa Coffee Club card is swiped or that you scan your Coffee Club mobile app in the usual way when you make your purchase. You cannot use Costa Coffee Club points to purchase Costa eGift Cards. You cannot earn Costa Coffee Card points when you purchase a Costa eGift Card. 6. Resale/Use in Promotions
You may only use your Costa eGift Card for your personal non-commercial use. You may not sell your Costa eGift Card. Costa eGift cards may not be used in sales or promotional activities including as give aways or prizes in competitions without the prior consent of Costa. Costa reserves the right to cancel any Costa eGift Card that it suspects has been resold or obtained in connection with an unauthorised sales or promotional activity.
7. Data Protection and Privacy
8. Liability of Costa
Costa shall not be liable for any loss or damage arising from or in connection with your use of a Costa eGift Card where such loss or damage arises from any cause beyond our reasonable control. If we fail to comply with these Terms and Conditions for a reason within our reasonable control, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into these Terms and Conditions. Where any loss or damage arises from a cause within our control, our liability to you shall not exceed a sum equal to the balance on your Costa eGift Card as at the date that such loss or damage occurs. This clause shall not exclude or limit any liability that cannot be excluded or limited by law.
We reserve the right to terminate the Costa eGift Card service on reasonable notice.
These Terms constitute the entire agreement and understanding between us and you with respect to your use of the Website and the purchase of Costa eGift Cards via the Website.
If any provision of these Terms is unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
Any failure or delay by us in enforcing (in whole or in part) any provision of these Terms will not be interpreted as a waiver of our rights or remedies.
We may transfer the benefit of these Terms to any other company in the same group of companies as Costa. If we assign the benefit of these Terms and Conditions, your rights will not be affected.
11. Governing Law
These Terms and Conditions are governed by English law. These Terms and Conditions are only available in English.
